Terms and conditions

How to book, what happens if the date changes, and who can do what with the photographs.

These terms apply to the photography services provided by Benedetto Zitoli, VAT number 03793090725, with a studio at Via Umberto 230, 76125 Trani (BT), trading on the site under the name Little Stories by Zitoli. I'm summarising them here so they're clear beforehand, not afterwards.

The economic terms of each session, meaning the price, the deposit, the delivery times and the cancellation notice period, are set out in the quote you receive before confirming. Once accepted, the quote takes precedence over this page.

1. How to book

Asking for information doesn't commit anyone to anything. The date is considered reserved only once you accept the quote in writing and pay the deposit stated in it. Until then, the date remains available to others.

2. If the date changes

For newborn sessions the date is, by definition, approximate: a window is set around the expected due date, and the exact day is agreed as soon as the baby is born. If the baby is born earlier or later, the session moves and the deposit remains valid. This is the norm, not an unforeseen event.

For other services, rescheduling is possible subject to availability in the calendar, provided you give notice within the notice period stated in the quote.

If an illness, a bereavement or a serious obstacle makes the session impossible, let's talk about it: we'll find a new date.

3. If you cancel

You can cancel at any time. How the deposit is handled in the event of cancellation is stated in the quote, and I explain it to you before you sign.

4. If I cancel

If illness, equipment failure or force majeure means I can't be there, I let you know as soon as I know and offer you a new date. If that doesn't suit you, I refund in full whatever you've paid. My liability doesn't extend beyond this refund.

5. How the session works

With newborns, the baby sets the pace: a session can run longer because of feeds and nappy changes, and this is part of the service.

Safety comes before any photograph. I never force a position, I never leave a baby balanced precariously, and I'll happily give up a shot that doesn't convince me. If the baby isn't cooperating, we photograph what we've got.

Please let me know in advance about any allergies, medical conditions or anything else I should know to work safely.

6. Selection and delivery

Selecting the images to deliver and their post production are part of the creative work, and I handle them myself. I don't deliver rejected shots or raw files.

The number of photographs delivered, the format and the timing are stated in the quote. Delivery is digital, unless you've ordered prints or albums.

I recommend saving the delivered files straight away in at least two different places. I keep the archives for the length of time stated in the privacy policy, but the definitive copy is yours.

7. Copyright and use of the photographs

Copyright in the photographs remains with the author, as provided for by Italian Law No. 633 of 22 April 1941. On delivery you receive the right to use the images for personal and family purposes: printing them, giving them as gifts, posting them on your social media profiles.

This doesn't include commercial or advertising use, transferring them to third parties for profit, or selling the images. Those uses require a separate written agreement.

I ask you not to alter the photographs with filters, heavy cropping or colour corrections before publishing them: the result is no longer the work I delivered. When you publish them, a credit is appreciated but not required.

8. Publication on my part

I don't publish any photograph of you without written consent, which is separate from the contract and which you can refuse without this changing anything about the service or the price. For images of minors, the consent of both parents or of whoever holds parental responsibility is required.

You can withdraw consent whenever you like, by writing to info@alessiazitoli.it: I remove the images from the site and from the profiles I manage. I can't do anything about copies already saved or shared by third parties.

9. Albums, prints and products

Albums, prints and frames are made to order, based on your selection. For this reason, under Article 59 of the Italian Consumer Code, they are not subject to the right of withdrawal once production has begun.

Before printing, I show you a draft for approval. After approval, any changes require a new order.

Colour differences between the screen and the printed paper are natural and don't constitute a defect: screens emit light, paper reflects it.

10. Right of withdrawal for services

If the contract is concluded remotely, you have the right to withdraw within fourteen days under Articles 52 and following of the Italian Consumer Code. If you ask for the service to be carried out before that period expires and the service is carried out in full, the right of withdrawal lapses.

11. Payments

The balance is paid within the terms stated in the quote. I issue a proper invoice for every session.

12. Complaints, applicable law and jurisdiction

If something isn't right, write to me at info@alessiazitoli.it: almost everything can be sorted out by talking about it.

This relationship is governed by Italian law. For the consumer, the competent court is that of the place of residence or chosen domicile, if located in Italy; in other cases the competent court is that of Trani.

The consumer may also turn to the European online dispute resolution platform.

13. Changes

I may update these terms. Any contract already concluded is always governed by the version in force on the day you accepted the quote.
